Effective as of the date above, I hereby delegate to you in your position and within your area of responsibility as Vice Chancellor – Academic Personnel authority to render decisions in connection with claims of retaliation in violation of the Whistleblower Protection Policy that are being considered under an academic personnel grievance or complaint procedure where you are the designated decision-maker. Your decision on the claim of retaliation will be final.

The Whistleblower Protection Policy provides that where warranted a fact-finding investigation be conducted of complaints by persons who allege, under oath, acts of reprisal or intimidation by University officials for reporting or attempting to report suspected improper governmental activities or any conditions that may significantly threaten the health or safety of employees or the general public. The results of such an investigation are to be presented to the Chancellor or his delegatee for a final decision.

This delegation will ensure that a single, coordinated process is used to resolve an academic personnel complaint that includes a claim of retaliation made under the Whistleblower Protection Policy and any other claim that a provision(s) of academic personnel policy or a collective bargaining agreement has been violated.

Questions concerning the standards to be applied in rendering a decision under the Whistleblower Protection Policy may be directed to the Locally Designated Official, Director Bill Cormier, Administrative Policies & Compliance Office.

This authority may not be further redelegated.
